ByeByeBias End User License Agreement and Privacy Policy

This End-User License Agreement (“EULA”) is a legal agreement between you (an individual) (“Licensor”) for the use of ByeByeBias. This EULA governs your use of the ByeByeBias provided by the Licensor. By using or installing ByeByeBias, you agree to be bound by the terms of this EULA.

License Grant - Licensor grants you a revocable, non-exclusive, non-transferable, limited license to install, and use ByeByeBias solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Restrictions on Use - You agree not to, and you will not permit others to:

1. Copy, modify, or create derivative works of ByeByeBias.
2. Distribute, transfer, sublicense, lease, lend, or rent ByeByeBias to any third party.
3. Reverse engineer, decompile or disassemble ByeByeBias, except to the extent expressly permitted by applicable law.
4. Remove, alter, or obscure any proprietary notices on ByeByeBias.
5. Use ByeByeBias in any manner that could damage, disable, overburden, or impair ByeByeBias.
6. Use ByeByeBias to create or distribute any malicious software or for any unlawful purpose.

Jurisdiction - This EULA and any disputes arising out of or in connection with it will be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of laws principles. Any legal actions or proceedings arising out of this EULA shall be brought exclusively in the courts of Utah.

Intellectual Property & Copyright Infringement - ByeByeBias and all rights, title, and interest in and to ByeByeBias, including all intellectual property rights therein, are and will remain the exclusive property of ByeByeBias. You agree to notify ByeByeBias promptly if you become aware of any infringement of ByeByeBias's intellectual property rights.

Termination of Licensing - ByeByeBias may terminate this EULA at any time if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of ByeByeBias and destroy all copies, full or partial, of ByeByeBias.

Warranty Disclaimer - ByeByeBias is provided “as-is” and with all faults. Licensor makes no warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. You bear the entire risk as to selecting ByeByeBias for your purposes and as to the quality and performance of ByeByeBias.

Limitations of Liability - To the maximum extent permitted by applicable law, in no event shall ByeByeBias be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use ByeByeBias; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from ByeByeBias; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our software by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through ByeByeBias; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

Limits on Damage Liability - ByeByeBias's total liability to you for any damages (regardless of the form of action) shall not exceed the amount actually paid by you for the ByeByeBias.

Control of ByeByeBias Distribution - You may not distribute or make ByeByeBias available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense ByeByeBias.

Phone Conditions

1. Creation of an account on ByeByeBias will require a verification of a valid cell phone number. For this purpose one text message be sent to Licensor at account creation. Message and data rates may apply. Licensor is responsible for any and all charges incurred according to the contract with the carrier.
2. Should any question or problem arise after receiving a text from ByeByeBias text system, Licensor can reply 'HELP' to any ByeByeBias text.
3. To never receive future texts from ByeByeBias, Licensor can reply 'STOP' to any ByeByeBias text.
4. Licensor will receive one text upon account creation. This is to verify Licensor's phone number's validity.

Updates & Changes – ByeByeBias reserves the right, at its sole discretion, to modify or replace this EULA at any time. By continuing to access or use our software after those revisions become effective, you agree to be bound by the revised terms.

Consent to Use of Data - You agree that ByeByeBias may collect and use any of your provided information, technical data on your systems, and related information (including but not limited to information about your device, system and application software, and peripherals) that is gathered periodically to facilitate the provision of ByeByeBias updates, product support, and other services to you related to the software. ByeByeBias can share your responses to any question on ByeByeBias in every situation, including for the sale of your information to third parties. However, a Licensor’s personal contact info (including both cell phone number and email address) will never be sold or shared with any third party under any circumstance. ByeByeBias will not exclude licensor’s phone number and opt-in data from the platform.

Question Input – Licensor will have the ability to pose questions to the ByeByeBias community.

1. Any questions that are input by Licensor become the property of ByeByeBias. Should you choose to stop using ByeByeBias, questions input by Licensor will remain.
2. Vulgar or inappropriate questions submitted by Licensor will be deleted from the system.
3. If ByeByeBias determines that the questions input by Licensor do not get adequate interest and interactions of the ByeByeBias community, those questions will be removed from ByeByeBias.

By using or installing ByeByeBias, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
